Whether information is being distributed in newspapers, magazines, on TV or on the Internet, it's all known as content. Today, content can be distributed over over many forms of media at the same time.

To make things complicated, there is no one clear agency that has control over all forms of media. As a result, communications law is a mix of regulations set up by the Federal Communications Commission, Congress, the Constitution and the court system. Because broadcasting crosses state borders, the federal government has been the one to take charge.

Congress gave the FCC power to set the standards for what can and cannot be broadcast over the air. Under the Communications Act of 1934, the FCC can issue licenses to operate TV and radio stations. It also has the power to impose heavy fines on whoever breaks its rules.

One growing section of communications law revolves around the FCC's decision to relax ownership laws. It's now easier for large companies to buy more than one radio or TV station in a city.

Currently, the Recording Industry Association of America and the Motion Picture Association of America have been in the news for suing people who allegedly download illegal copies of songs and movies. Their lawsuits are based on copyright law. According to copyright law, it may be illegal to copy songs or movies and give them to others for free.

Obscene Speech is Not Protected by the First Amendment

Obscene speech is not protected by the First Amendment and cannot be broadcast at any time. The Federal Communications Commission (FCC) may revoke a station license, impose a monetary forfeiture, withhold or place conditions on the renewal of a broadcast license, or issue a warning, for the broadcast of obscene or indecent material.

To be obscene, material must meet a three-prong test:

An average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest;

The material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and

The material, taken as a whole, must lack serious literary, artistic, political, or scientific value.
